California Consumer Privacy Act (CCPA) Rights
This policy supplements our Privacy Policy and applies only to California residents ("Consumers" or "you") who visit futurepathadvisors.cloud, use the services provided through this website, or submit their information to Future Path Advisors. It is provided in accordance with the California Consumer Privacy Act of 2018 ("CCPA") and other applicable California privacy laws. Terms that are defined in the CCPA have the same meaning when used in this policy. Here we explain how we collect, use, disclose, and in some cases "sell" Personal Information from California consumers, and how you can exercise your rights under the CCPA. Only California residents—or their authorized agents—may submit CCPA requests regarding their Personal Information for verification and processing. We may update or modify this policy at any time, and any changes take effect when we post the revised version. Your continued use of the website after changes become effective constitutes your acceptance of the updated policy.
1. Request to Know How Your Personal Information Is Collected, Disclosed, or Sold
California consumers have the right to request that we disclose the categories and specific pieces of Personal Information we collect, use, disclose, and sell about them. You may submit a CCPA "request to know" by emailing us at contact@futurepathadvisors.cloud. After we receive your request, we are required by law to confirm that the person making the request is the same consumer whose information we hold in our records. To verify identity, we may ask you to provide certain limited information, which may include, but is not necessarily limited to:
- (a) full name;
- (b) physical address;
- (c) email address; and
- (d) last four digits of a social security number.
We will only request information that you previously provided to us when you submitted your information on the website. Once we have verified your request, we will disclose to you, as required by the CCPA:
- The categories of Personal Information we collected about you;
- The categories of sources from which that Personal Information was collected;
- Our business or commercial purposes for collecting or selling that Personal Information; and
- The categories of third parties with whom we have shared that Personal Information.
As described in our Privacy Policy, we collect several types of information when consumers use this website, including Personal Information, demographic data, behavioral and usage information, and indirect information. Personal Information is collected both directly and indirectly from your use of this website and your interactions with us—for example, when you submit a loan request form to be connected with lenders. Future Path Advisors may receive monetary compensation for disclosing or sharing ("passing") your Personal Information with:
- (i) affiliated entities;
- (ii) financial service providers;
- (iii) information and data aggregators;
- (iv) lenders, including tribal lenders; and
- (v) advertisers.
We share and disclose Personal Information for the following business and commercial purposes:
- (a) to help consumers obtain the financial services or short‑term loans they request through this website;
- (b) to allow third parties to advertise and offer related products and services to consumers;
- (c) to respond to consumer inquiries, complaints, or opt‑out requests;
- (d) to maintain, improve, and personalize this website and the user experience;
- (e) to protect the security and integrity of the website and its services; and
- (f) to comply with or respond to regulatory, governmental, or law‑enforcement requests as required by law.
Under the CCPA, "Personal Information" does not include certain types of information, such as:
- (a) publicly available information from government records;
- (b) de‑identified or aggregated consumer information;
- (c) information not covered by the scope of the CCPA; or
- (d) Personal Information subject to specific industry privacy laws, including the Fair Credit Reporting Act ("FCRA"), the Gramm‑Leach‑Bliley Act ("GLBA"), or the California Financial Information Privacy Act ("FIPA").
2. Request to Delete Your Personal Information
California consumers also have the right to request that we delete certain Personal Information we have collected or maintained about them in the past twelve (12) months, subject to applicable legal exceptions. To request that we delete your Personal Information, you may contact us at contact@futurepathadvisors.cloud with the subject line "CCPA Right to Delete." After we verify your identity and confirm your request, we will archive your Personal Information in a secure, encrypted database that is scheduled for destruction three (3) years from the date you originally submitted your information to the website, and it will no longer be used for any operational purpose.
Immediate deletion may not always be possible due to contractual and statutory requirements, including those set forth in the Telephone Consumer Protection Act ("TCPA"), the CAN‑SPAM Act of 2003 ("CAN‑SPAM"), and California Business and Professions Code Section 17529.5. In such cases, we will retain only the amount of information necessary to satisfy those obligations.
3. Request to Opt‑Out of the Sale of Your Personal Information
California consumers may request to opt‑out of any "sale" or sharing of their Personal Information by a business. By submitting a loan request on this website, however, you are expressly asking us to share your information with lenders and third parties in order to connect you with short‑term loans or other financial services, which may qualify for an exemption from this right. If you nonetheless choose to submit a CCPA opt‑out request, we will honor that request and stop further sharing or selling of your Personal Information.
Consumers have the right not to be discriminated against for exercising their CCPA rights. Future Path Advisors does not deny services, charge different prices, or provide a different level or quality of service because you have submitted a CCPA request. Please note, however, that if you opt‑out of the sale or sharing of your Personal Information, we may be unable to provide certain services that depend on passing your information to third parties.
4. Limitations and Verification
California consumers may submit a verifiable CCPA request to us no more than two (2) times within a twelve (12) month period. A "verifiable consumer request" must: (a) provide enough information for us to reasonably verify that you are the person about whom we collected Personal Information (or an authorized agent of that person); and (b) clearly describe your request so we can properly understand, evaluate, and respond to it—for example, whether you are requesting to know, delete, or opt‑out. For security and privacy reasons, we will not respond to requests we cannot verify. Any Personal Information you provide in connection with a CCPA request will be used solely to verify and process that request.
In addition to the rights described above, California residents may also request a list of third parties to whom we have disclosed certain Personal Information for their own direct marketing purposes during the prior calendar year. To make such a request, please contact us using the information provided in this policy.
5. Our Response to Requests
We strive to respond to verifiable consumer requests within forty‑five (45) days of receipt, as required by the CCPA. If we need additional time (up to an additional forty‑five (45) days), we will notify you in writing and explain the reason for the extension. When possible, we will deliver our response electronically to the email address you provide with your request.
